As a “Hook Your Girl Up” member (“Referrer”), you are subject to Birthday Girl’s Terms as well as the following terms for our “Hook Your Girl Up” program. Participation in this program requires that you submit your email address and that of another individual (“Friend”). All personal information that is collected, processed, and used will be done in accordance with our Privacy Policy (insert link) and the Program’s Privacy Terms, discussed below. 

  1. Eligibility. To be eligible to participate in the program, you must meet these qualifications:
    1. Be a legal resident of the fifty (50) United States or District of Columbia, Guam, Puerto Rico, and the US Virgin Islands;
    2. Be 13 years of age or older;
    3. Have a membership account in good standing with Birthday Girl World
  2. Privacy. To participate in the program, members must supply personal information about themselves, such as email address and name. This will aid us to track the Referral links to allow us to accurately credit the accounts after qualified purchases. As with all personal information collected on the Site, the information will be handled and processed in accordance with our Privacy Policy as stated above.
  3. Communication. By participating in the Program, members give consent to be contacted by Birthday Girl World through email in regards to the Program and any products sold by Birthday Girl.
  4. How the Program Works. To participate in the program, you must follow the instructions to create an account. Once you become a member (Referrer) you will be given a Referral link to refer as many friends, family members, or colleagues as you want to the Program! For every “Qualified Referral” (as defined below) you submit to us, you may be eligible to receive Referral Credit(s) (defined below).
  5. Qualified Referral. A “Qualified Referral” requires that all of the following conditions are met:
    1. Your Friend must have registered and created an account with Birthday Girl;
    2. Your Friend meets all of the eligibility requirements as previously stated;
    3. Your Friend has agreed to the “Hook Your Girl Up” Program Terms of Agreement as well as the Site’s Terms of Agreement
    4. The Referrals need to be verified by Birthday Girl World. Through the verification process, if Birthday Girl World, at its sole discretion, believes the transaction to be in violation of our Terms and Conditions, or suspicious and fraudulent, Birthday Girl reserves the right to suspend processing the transaction;
    5. Your Friend must complete a purchase of $45 USD or more (excluding all fees including but not limited to taxes, shipping, and/or other fees at our online store, located at www.birthdaygirlworld.com, by clicking on your unique Program link located in the sent to your Friend. (If your Friend makes a purchase on our website through any other method, this will NOT count as a Qualified Referral and you will not earn any store credit.)
    6. Your Friend must complete their Qualified Purchase within thirty (30) days of receiving the Program email;
    7. Your Friend does not return the Qualified Purchase;
    8. Your Friend must be a new customer – i.e. they have not previously purchased from our online store. You may only receive one (1) Qualified Referral per Friend; in other words, you are only eligible for one (1) Referral Credit per Friend, and so additional/repeat purchases made by your Friend do not qualify you for additional Referral Credit(s).
  6. Referral Credits. For each Qualified Purchase, your Friend will receive their Referral Credit discount online at the time of purchase. Subsequently, for each verified Qualified Referral, you will be emailed a notification that you have one (1) Referral Credit valid for future purchases at our online store. Referral Credit(s) will appear in your online account with us thirty (30) days after your Friend makes a Qualified Purchase. Some important things about your Referral Credit(s):
    1. Referral Credits may not be used toward the purchase of a gift certificate or combined with any other promotional codes or offers.
    2. Referral Credits are non-transferable and may not be sold, assigned, or given to anyone else, and may not be redeemed for cash.
    3. Referral Credits are valid for one-time use only and are non-refundable – for instance, if you use a Referral Credit to purchase an item from our store and you later return that item, the amount of the Referral Credit used by you to pay for the item will be deducted from the total amount of your refund.
    4. Referral Credit(s) do not expire.
  7. Disqualification from Program: The following actions will result in your disqualification from the Program. Such actions include but are not limited to: Violating applicable state or federal laws, transmitting any file/program that contains viruses, worms, Trojan horses, or any destructive features, submitting information relating to third parties to the “Hook Your Girl Up” program without their consent, impersonating someone or misrepresenting yourself, interfere with the operation of the Program.Birthday Girl reserves the right, in its sole discretion to void any referral’s credits, suspend or disqualify an account, for any action we deem to be in violation of our policy or any behavior to misuse the Program. Birthday Girl’s decisions are final.
    1. Mass-Messaging (Spam)
      1. Any messages or any form of mass-messaging, containing your referral link that is deemed to be spam in nature (unsolicited email/correspondence), by the Company’s sole discretion, will disqualify you from the program.
    2. Misrepresentation
      1.  You can only refer real people. Self-referrals are not permitted. Any action that is intended to misrepresent yourself will result in your account being terminated. Such actions include but are not limited to creating multiple accounts with emails, any attempt to alter the referral code.
      2. Use of any automated system or any system to cheat and hack the system to generate a qualified referral will result in your disqualification.
      3. Harassment
        1. Any action deemed to be harassment under any applicable law or regulation will result in your account being terminated.
  8. Right to Cancel Program or Change Terms. Birthday Girl may in its sole and absolute discretion, amend these Terms without notice. Birthday Girl in its sole and absolute discretion, may amend, suspend, or cancel the Program, or any part, at any time without notice or for any reason. We may also deny participation to the Program if we have any reason to believe that you are in violation of our Terms and/or the Terms of the “Hook Your Girl Up” Program.
  9. Indemnification. By participating in the Program, Members defend, indemnify, release and hold harmless Birthday Girl World, its subsidiaries, affiliates, and its or their parent companies, suppliers, advertising and promotions agencies, third-party sites, and their respective directors, officers, employees, and agents (collectively, “Released Parties”) from any and all claims, actions, demands, liability, losses, damages, cost or expense, arising out of or in any way connected to the Program and/or the use of any Rewards (including, without limitation, any property loss, damage, personal injury or death caused to any person(s).
  10. Governing Law. The laws of the State of New York shall govern these Rewards Terms and Conditions. Member hereby expressly consents to exclusive jurisdiction and venue in the courts located in New York for all matters arising in connection with these Rewards Terms and Conditions or Member’s participation in the Program.
